Grants 2023 for the promotion of Spanish and foreign patent and utility model Applications

The following is an extract from the Resolution of the Directorate of the Spanish Patent and Trademark Office, O.A., announcing the award of grants on a competitive basis for the promotion of applications for patents and utility models in Spain and abroad for the year 2023.

 

First. Purpose.

 

The call consists of two programmes:

 

a) Aid programme for the promotion of patent and utility model applications abroad: this consists of subsidising activities that entail costs for the payment of fees for obtaining a European, international or national patent in foreign national offices.

b) Aid programme for the promotion of applications for Spanish patents and utility models for SMEs and individuals: this aid focuses on subsidising applications for Spanish patents and utility models that involve the payment of a fee.

 

Second. Beneficiaries.

 

1. Programme for the promotion of patent and utility model applications abroad: a person with residence and tax domicile in Spain who meets any of the following requirements:

 

a) That he/she is a natural person.

b) That he/she is considered an SME.

c) A large private company.

d) It must be a private non-profit institution without dependence on or links to the public sector.

 

The applicant must have applied for a patent and/or utility model abroad, either directly or through a representative, in accordance with the requirements set out in this call for applications.

 

2. Aid programme for the promotion of applications for Spanish patents and utility models: a person with residence and tax domicile in Spain who meets any of the following requirements:

 

a) That he/she is a natural person.

b) They must be considered an SME.

 

The applicant must have carried out directly or through a representative any of the activities contained in the call for applications.

 

Third. Amount.

 

1. Programme for the promotion of patent and utility model applications abroad: this may not exceed the amount of 7,309,481.00 euros in this call. Reference amounts will be assigned according to the country or group of countries in which the eligible activity has taken place and which are indicated in Annex I of the call. The grant may not exceed 80% of the above-mentioned amounts; if the applicant is an SME or a natural person, the grant may not exceed 90% of the above-mentioned amounts.

 

2. Aid programme for the promotion of applications for Spanish patents and utility models: the amount of 330,730.00 euros may not be exceeded in this call for applications. The aforementioned activities will be assigned the reference amounts indicated in Annex II of the call. The subsidy may not exceed 90% of the amounts indicated.

 

Fourth. Deadline for submission of applications.

 

The deadline for submitting applications will be one month from the day following the publication of the extract of this call for applications in the "Boletín Oficial del Estado" (BOE 25-04-2023).

 

Fifth. Other information.

 

1. Programme for the promotion of patent and utility model applications abroad: the activities indicated in the call for applications whose expenditure has been incurred between 1 January and 31 December 2022 are eligible.

 

2. Aid programme for the promotion of applications for Spanish patents and utility models: activities indicated in the call that have been published in the BOPI during the years 2020, 2021 and 2022 are eligible.
