Adapting the use of cookies to the new European guidelines: everything you need to know

The Spanish Data Protection Agency (AEPD) has updated the Guide on the use of cookies to adapt it to the Guidelines 03/2022 of the European Data Protection Committee (ECDC). Below, we list the most important changes that must be implemented before 11 January 2024.
New additions
- The options to accept and reject cookies will be displayed in the specific place and format so that the difficulty of selecting one of them does not influence the choice.
- The Guide will provide a set of guidelines to understand the indications to be followed when inserting the two buttons mentioned in the previous point (colour, size, silhouette, etc.).
Modifications
- If the user makes choices about personalisation cookies, such as choosing the language of a website or the currency for transactions, these are considered technical cookies that do not require consent, but cannot be used for other purposes.
- Where the publisher makes decisions about personalisation cookies based on information collected from the user, it must prominently disclose this and offer the option to accept or reject them. In this case, the publisher is also not allowed to use them for other purposes.
- Cookie walls: There are cases where not accepting cookies prevents access to the website or the use of all or part of the service. However, in the new version of the Guide, the user should be aware that, although the publishers offer alternatives for accessing the service without the need to accept the use of cookies, it is possible that a cost may be imposed to enter.
